Terms & Booking Conditions

Coboat is operated by Coboat Ltd., Global Gateway 8, Rue de la Perle, Providence, Mahé (Seychelles). The attention of the coworking space and sailing cruise participant is drawn to the conditions below which constitute the contract between the participant and Coboat Ltd.

Prices are in Euro and are prepared as full board accommodation, per person in a cabin with double or tripleor quadruple occupancy (unless specified differently in the programme). If you would like to stay alone in a cabin, you are required to contact Coboat Ltd. about availability and costs for single occupancy.

Coboat Ltd. reserves the right to decline any person as a guest in the sole discretion of Coboat Ltd. should such a person’s health or mental condition or physical infirmity or general deportment impede the operation of the trip or the rights or welfare or enjoyment of other trip passengers.

  1. Booking and Payment

Making a booking signifies your acceptance of the terms of Coboat’s general waiver of liability

To make your booking: A 50% deposit for each person and each week booked is required, which should be forwarded to bank account mentioned below immediately after the booking is made. Your payment of 50% of the total bill will act as a deposit and it will serve as final confirmation of your reservation.

We strongly recommend you book your ticket as early as possible to ensure your place on the desired trip.

Balance must be paid to Coboat Ltd. no later than 8 weeks prior to your departure. In the event of failure to complete the payment on time, your reserved trip will become available for general sale and Coboat Ltd. reserves the right to retain the deposit you have paid in accordance with the cancellation conditions stated under clause 2. If the booking is made less than 8 weeks before departure the whole cost must be paid at the time of booking. Travel documents will be issued approximately 14 days before departure, provided full payment has been received. In the event of late payment resulting in late delivery of documents Coboat Ltd. accepts no responsibility for the consequences thereof.

It is your responsibility to check the payment dates and ensure that payments have been made in accordance with the payment instalment plan. Any delay in payment may result in cancellation of the booking by Coboat Ltd. without refund. If you are likely to be unable to make a payment on time you must contact Coboat Ltd. as soon as possible to request an extension to the relevant payment deadline. If such an extension is agreed upon, Coboat Ltd. will provide written confirmation thereof.

                                                       

The first payment must be made within 24 hours of receiving the booking confirmation or else the booking will be cancelled and made open to other customers.

Once the first payment is made on time the booking is fixed and a binding contract exists between you and Coboat Ltd.

All payments can be made by Paypal, Bank transfer or other payment methods described on the website.

When you make the payment by the bank transfer you need to mention the booking number, guests name and travel date on the description part.

 

  1. No Transfer of Tickets, Cancellation conditions and change of booking dates

Tickets cannot be transferred to any third party.

In the event of a change of booking dates a 10% service fee will be charged.
 Additionally, due to administrative efforts and the risk of an uncompensated empty space on board the following penalties shall apply:

– 40% of the total price shall be charged in case the notice of change of booking reaches Coboat Ltd. at least four weeks prior to departure.

– 90% of the total price shall be charged in case the notice of change of booking reaches Coboat Ltd. less than four weeks prior to departure.

The above mentioned penalties shall be refunded if the originally booked space can be resold by Coboat Ltd.

Booking dates can only be changed provided that space is available

In the event of cancellation of a trip the following shall apply:

If 50% or less of the booking fee have been paid as a deposit there shall be no refund.

If 100% of the booking fee have been paid and the cancellation notice reaches Coboat Ltd. at least four weeks prior to departure, the participant shall receive a 50% refund.

If the cancellation occurs less than four weeks prior to departure, there shall be no refund.

Your travel insurance policy may cover cancellation charges and charges due to the change of booking dates, please check your individual policy for details.

  1. Refunds

Refunds will normally be made to the booking party. Coboat Ltd. can only be responsible for refunding amounts actually received. No refunds will be made to passengers who do not board the boat or passengers who cancel after the start of the trip. The purchase of travel insurance is recommended. Clause 5 remains unaffected.

  1. Insurances (travel, health)

Coboat Ltd. does not sell or organise individual personal insurances.

It is a condition of the booking that participants do have sufficient health insurance which covers adventurous activities such as sailing. Confirmation of such insurance must be presented to Coboat Ltd. before boarding and participants without insurance will not be taken on board.

It is highly recommended to have additional insurance cover such as travel, accident, cancellation, luggage and trip-interruption insurance.

Coboat Ltd. has fully comprehensive and third party insurances. However, these insurances do not cover the accidents or injuries etc. that may occur on the trip.

  1. Sequence of itinerary, trip cancellation, trip interruption

Sequence of destinations and sites may change from the order given on the website.

Coboat Ltd. reserves the right to cancel the whole or any part of a tour at any time as a result of force majeure or for reasons outside Coboat Ltd.’s control, including but not limited to the failure of any third party to perform. Any related cancellation fees charged by a third party such as, but not limited to, airfares, other transportation fees, accommodation are the responsibility of the participant.

Coboat Ltd. cancel any cruise at any time for any reasons of force majeure.

During the cruise should the boat sustain any breakdown in machinery, or be disabled by fire, grounding or collision disrupting the cruise itinerary for more than 48 hours, and if no substitute boat or arrangement is offered, passengers will be entitled to a refund proportional to the cruise days not operated. No further claims shall be made against Coboat Ltd.

  1. Force Majeure

In this Terms & Booking Conditions “force majeure” means any cause directly attributable to acts, events, non-happenings, omissions, accidents or Acts of God beyond the reasonable control of Coboat Ltd. (including, but not limited to, strikes, lock-outs or other labour disputes, civil commotion, riots, blockade, invasion, war, fire, explosion, sabotage, storm, bad weather conditions, collision, grounding, fog, governmental act or regulation, major mechanical or electrical breakdown beyond the crew’s control and not caused by Coboat’s negligence).

Coboat Ltd. shall not be made liable for any loss, damage or expense resulting from war or terrorist activities, threatened or actual, civil unrest, industrial action, weather conditions, fire, flood, drought, airport regulations and closure, unforeseen alterations to public transport schedules, rescheduling of aircraft, boats, or any type of transportation means or any other event outside Coboat Ltd.’s control which either delays or extends the trip arrangements.

Coboat Ltd. shall not be held liable for any client who contravenes any law or regulation of any of the countries visited while on the tour.

  1. Transfers

All necessary group or single person transfers between airports and harbours are not included throughout the trip. Coboat Ltd. does not provide or arrange land transportation.

  1. Not included in the Tour Rates

Passport costs, immigration fees and immigration related costs, domestic and international airfare, photography fees payable at admission sites, excess baggage, forwarding of baggage and souvenirs, alcoholic beverages and all personal expenses are not included in the fees charged by Coboat Ltd. Customary tips to the crew and guides, which are left to participants’ discretion, are also not included.

  1. Travel Documents

Participants must be in possession of a valid passport (expiring no earlier than six months after completion of the trip) and should obtain visas and health certificates where required. All requirements should be confirmed with appropriate government consulate or information office prior to departure. It is the passenger’s responsibility to obtain any visas, passports, health certificates or other travel documentation required.

Coboat Ltd. cannot provide assistance obtaining passports, visas, or other documents required to participate in the trip provided by Coboat Ltd..

  1. Luggage and Clothing

It is advised to travel as lightly as possible so as not to restrict any cabin space. Soft bags are more practical than hard suitcases. Sports or casual clothes are recommended. Plenty of swimwear is required and a pullover or cardigan is recommended for cool evenings. Comfortable walking shoes are suggested when ashore.

  1. Health requirements

Due to safety reasons it is requested that health restrictions of any kind are made known to Coboat Ltd. at time of reservation. It is understood that passengers requiring special attention or treatment will be travelling with their escorts. Coboat Ltd. retains the right to refuse to embark any pregnant woman beyond the 6th month of pregnancy for safety reasons.

Any special needs/requirements must be disclosed so that suitable arrangements can be made. Coboat Ltd. shall not be held liable if a participant’s trip is impacted due to the participant’s failure to inform Coboat Ltd. of any special needs/requirements. If support or advice is required, please contact Coboat Ltd. prior to booking using the contact details available on our website.

In case of a medical condition, mobility problem or a disability, possibly affecting a participant’s trip, Coboat Ltd. may require a doctor’s certificate or other documentation relating to such condition, problem or disability. Please provide full details of any such condition, problem or disability in writing at the time of booking.

Our boat is not suitable for passengers with special needs or wheel chairs. There are no embarkation gang ways. Cabin bathrooms and stair cases are unsuitable for disabled passengers and wheel chairs.

It is a prerequisite of booking that participants have reasonable swimming abilities, meaning they must be able to swim for at least 20 minutes in open water.

  1. Special Dietary Requirements

Every attempt to meet special dietary requirements will be made provided that such a request is put to Coboat Ltd. in writing at least 4 weeks prior to the start of the booked trip.

  1. Airports and locations

Details about exact locations of embarkation and disembarkation are announced on Coboat Ltd.’s website as they become available.

These locations will be as close to domestic airports as possible. However, local land or sea transfer might be necessary.

Coboat Ltd. will always inform participants of the closest international airport within reach of the trip.

Local/Domestic airports will be announced closer to the trip date, no later than 1 week before departure.

Be advised that the final location of pick-up (usually by dingy) may be announced at short-notice.

  1. Embark/Disembark

Check-in and boarding starts at 3 pm on your first day and will end at 9 pm. Passengers who fail to appear at the pick-up location in time will be rejected from the trip without a refund.

Check-out is at 9 am on the last day after breakfast.

As the first and the last days are transfer days, these nights will be spent at the embark/disembark location (from Friday until Sunday early morning).

The captain may make changes to the cruise programme according to the sea and weather conditions. This is for the safety and security of our guests. Sailing will not be carried out in case of winds of 6 Beaufort or more.

It is not allowed to bring drinks or alcoholic beverages aboard from outside (waste and safety reasons). A selection of drinks can be purchased from the bar of the yacht between 5-9 pm at a reasonable price and bills will be paid at the end of the cruise.

  1. On the boat

Instructions of the boat will be given to our guests at the time of embarkation.

Cabins have private WC/shower, portholes and a small wardrobe. The toilets are marine type with a pump or electrical flush.

There is sufficient safety equipment on board including life jackets & lines, dingy boats and a life raft. These all meet international safety requirements.

We provide sufficient opportunities to charge your electrical gadgets.

Each cabin is provided with one face and body towel per person. These towels are for bath usage only and cannot be used for sun bathing on deck. It is recommended to bring personal sun bathing towels on board.

  1. Sports activities

Certain water sports activities such as, but not limited to, diving will require medical clearance and appropriate licenses. It is within the responsibility of the participant to fulfil those requirements.

Participation in such activities require acceptance of PADI’s general medical statement and liability form.

Activity vouchers cannot be transferred between weeks or refunded if not redeemed.

  1. Pets

Bringing pets aboard is not permitted. Crew is required to maintain rigid cleanliness standards for all their guests and there is a potential of allergens from animals remaining on board.

  1. Smoking

Smoking is not permitted to any of our passengers or members of the crew in any indoor part of the boat.

  1. Photos and Marketing

The passenger consents to Coboat Ltd. using images taken of the passenger during the tour for advertising and promotional purposes in any medium at Coboat Ltd.’s sole discretion. The passenger grants Coboat Ltd. a perpetual, royalty-free, worldwide irrevocable license to use such images for publicity and promotional purposes.

                                                       

If a passenger wishes not to be on camera/video this must be brought to the attention of Coboat Ltd. through an email to [email protected] before the commencement of the trip. This must include the name and contact details of the person who does not wish to be photographed or filmed along with booking reference and contact details.

  1. Internet

We are aware that reasonable internet access is an essential feature of our co-working experience and undertake sufficient efforts to provide internet connection.

However, uninterrupted connection cannot be guaranteed at all times.

Certain services that are high in data volume consumption may be restricted at all times.

Individual data volume may be limited in certain areas.

  1. Behaviour policy

If, while on the trip, a passenger’s behaviour poses a danger to himself/herself or other passengers or members or crew, causes or is likely to cause damage to people or property, breaches any local law, or causes a public disturbance Coboat Ltd. shall have the right to cancel a booking without refund. In such a case a passenger may be asked to disembark at any port throughout the cruise.

There is a strict no drugs policy on board the yacht and misuse of drugs will be reported to local authorities.

Responsible drinking habits are expected of all passengers and Coboat Ltd. reserves the right to limit personal alcohol consumption on board.

  1. Complaints                                                     

Coboat Ltd. welcomes all your suggestions for improvements as well as your feedback on our cruise operation and our crew.

If you are unhappy with the performance or any element of a booking made through Coboat Ltd. this should be made known to a member of Coboat Ltd. staff at the earliest possible time. We will then attempt to find an appropriate solution. Please allow us the opportunity to solve the problems you are experiencing. Many complaints can be rectified on the spot or will be referred to a more senior member of staff. Failure to register a complaint at an early point in time is likely to affect your right to compensation.

                                                       

In terms of any complaints during the trip please note that they must be communicated to Coboat Ltd. immediately and while on board.

  1. Responsibilities

Coboat Ltd. is responsible for making all the arrangements specified in the services and itineraries.

Coboat Ltd.’s liability and responsibility does not extend beyond the boat; any arrangements made by or for passengers either before boarding or when disembarking are at the passenger’s own risk. Coboat Ltd. does not own or control any ground transportation or hotels. As a convenience to our passengers, Coboat Ltd. may sell tickets for land excursions or arrange other services which are operated by independent contractors. However, Coboat Ltd. shall not be responsible in any way whatsoever for any damage, loss, injury or death arising during such excursions.

Coboat Ltd. will not be liable where any damage was caused due to (a) the acts and/or omissions of the person(s) affected; (b) the acts and/or omissions of a third party not connected with the provision of the holiday and which were unforeseeable or unavoidable; (c) unusual and unforeseeable circumstances beyond Coboat Ltd.’s control, the consequences of which could not have been avoided even if all due care had been exercised; or (d) an unusual event which either Coboat Ltd. or the supplier of the service(s) in question could not have foreseen or avoided even with all due care.

                                                       

Coboat Ltd.’s liability is, in all cases other than personal injury, limited to twice the price of the trip booked.

                   

You are obliged to assist Coboat Ltd. in recovering from any third party any sum that may compensate Coboat Ltd. for any claims made by you. In particular you are obliged to assign to us any claims that you may have against any other persons whose acts or omissions have caused or contributed to Coboat Ltd.’s liability to you. You shall also provide Coboat Ltd. with all the assistance reasonably required. However, any sum received by you from third parties in respect to an occurrence which might also raise claims against Coboat Ltd. will be deducted from any sum paid to you as compensation by us.

                               

Where any claim or part of a claim (including those involving death or personal injury) concerns or is based on any travel arrangements (including the process of getting on and/or off the transport concerned) provided by any air, sea, rail or road carrier to which any international convention or regulation applies, the maximum amount of payable compensation by Coboat Ltd. will be limited in accordance with such conventions.

                                                                                                                   

Coboat Ltd. and those associated with it are not responsible for organising activities, excursions etc. on-site. Such activities will not form part of package arrangements. If a passenger suffers illness or injury arising out of an activity that does not form part of the contractual package arrangements Coboat Ltd. shall not be held liable.

Other than as is detailed in these Terms and Conditions Coboat Ltd. shall have no legal liability whatsoever for any loss or damage suffered which arises directly or indirectly from any aspect of the package booked with Coboat Ltd.

  1. Final Provisions

If single provisions of these Terms and Booking Conditions should be deemed unlawful, void or unenforceable it shall be deemed severable from these Terms and Booking Conditions and shall not affect the validity and enforceability of the remaining provisions. The parties agree to replace any invalid provisions with such which approximates to the closest intended purpose of the invalidated provision in regard to spirit and purpose. In the case of gaps, the parties shall agree in accordance with the spirit and purpose of the standard Terms and Booking Conditions.

Changes or additions to these Terms and Booking Conditions shall be effective only if made in writing. The same shall apply for any waivers for written-form requirements. Verbal agreements shall be deemed invalid.

  1. Enforcement

No failure or delay by Coboat Ltd. in enforcing these terms shall prevent Coboat Ltd. enforcing them at a later date or act as a waiver of its right to do so. Similarly, partial enforcement shall not preclude further enforcement of the same, or another, term at a later date.

  1. Assignment                                                   

Rights or obligations under these Terms and Conditions may not be transferred without prior written consent by Coboat Ltd.
